1. Entity Clarification

For purposes of these Terms and all AFI English policies, the terms “AFI English,” “Applied Fluency International,” and “Applied Fluency International LLC” may be used interchangeably. All three designations refer to Applied Fluency International LLC, a Wyoming-registered company. Branding and marketing may use “AFI English” or “Applied Fluency International,” but the legal entity of record remains Applied Fluency International LLC. If and when “AFI English” or “Applied Fluency International” are registered as “doing business as” (DBA) names, they will remain under the ownership, control, and legal responsibility of Applied Fluency International LLC.
 
AFI English (Applied Fluency International LLC) provides educational content and language training services for informational and learning purposes only. While we strive for accuracy, quality, accreditation and professionalism, AFI English makes no representations or warranties of any kind, express or implied, regarding specific outcomes, including but not limited to exam results, employment opportunities, immigration approvals, or any other future events.
 
By using AFI English services, whether through this website, affiliated platforms, or community spaces, you agree that AFI English shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or in connection with your reliance on the information or services provided.

​2. Scope and Acceptance


These Terms govern your use of AFI English websites, apps, booking portals, video platforms, and any services, classes, consultations, subscriptions, or learning materials that we provide (together, the “Services”).

By creating an account, booking or attending a lesson, or using any part of the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

No professional guarantees. AFI provides language-learning and educational support only. We do not guarantee exam scores, immigration outcomes, job offers, school admissions, or any other future result.

3. Eligibility; Minors and Guardians
You must be at least 18 years old to book or pay for Services unless a parent or legal guardian does so on your behalf.
   •    If the learner is a minor, a parent or legal guardian must:
   •    Create or approve the account
   •    Accept these Terms
   •    Provide any required consent forms
   •    We may request proof of age or identity for safety and compliance reasons.

Parents and guardians are responsible for supervising minor learners as appropriate.

4. Accounts, Security, and Acceptable Use


You are responsible for:
   •    Maintaining the confidentiality of your login details
   •    All activity that occurs under your account

You agree not to:
   •    Upload or share illegal, obscene, infringing, or harmful content
   •    Disrupt lessons, attempt to hack or bypass security, or misuse the platform
   •    Misrepresent your identity or pretend to be someone you are not
   •    Harass, threaten, or discriminate against any learner, teacher, or staff

Harassment and hate speech include, for example:
   •    Using slurs or offensive stereotypes
   •    Mocking or glorifying violence, genocide, slavery, or crimes against humanity
   •    Targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, nationality, or similar traits

AFI English may remove content or terminate access if we believe behaviour is unsafe, disruptive, or inconsistent with these standards.

5. Lessons, Bookings, and Cancellations


This section applies to all paid lessons, packages, and consultations directly booked with AFI.

5.1 Booking
   •    Lessons are booked through our website or any official AFI booking tool.
   •    Availability and scheduling are subject to change; we will confirm bookings by email or within the platform.

5.2 Student Cancellations
Unless we communicate a different policy in writing for a specific course:
   •    24 hours or more before the lesson start time:
   •    You may cancel or reschedule, and we will credit the full value toward another lesson.
   •    Less than 24 hours before the lesson start time:
   •    The lesson may be treated as delivered and charged in full.

For multi-lesson packages, the same rules apply at the session level. Unused sessions normally expire 12 months after purchase unless otherwise stated in the course description.

5.3 AFI Cancellations
If AFI cancels a scheduled lesson or is unable to provide the teacher:
   •    We will offer to reschedule at no extra cost or provide a credit of equal value.
   •    This is your primary remedy in case of AFI cancellation.

5.4 No-Shows and Lateness
   •    If you do not attend or are more than 15 minutes late without notice, the session may be treated as delivered and charged in full.
   •    If AFI is significantly late (for example, more than 15 minutes), we will reschedule or credit the session.

6. Payments, Billing, and Taxes

   •    Prices are shown at checkout. We may adjust pricing prospectively at any time.
   •    Payment is due at the time of booking or as otherwise specified for a course or package.
   •    We use third-party payment processors. By purchasing, you authorize the processor to charge your chosen payment method.
   •    You are responsible for any applicable taxes or bank fees.

If you believe a charge is incorrect, you must contact us promptly at contact@afienglish.com so we can review it before you file a chargeback with your bank.

7. Refunds


AFI generally does not offer cash refunds except where required by law. Our default remedies are:
   •    Rescheduling a lesson, or
   •    Issuing a credit that can be used toward future lessons

In cases where AFI is clearly at fault (for example, persistent technical failure on our side that prevents a lesson from taking place), we may issue a refund or credit at our discretion.

Once a lesson has been delivered, fees are normally non-refundable.

8. Intellectual Property and Content Use


All AFI course materials, slides, worksheets, recordings, handouts, logos, branding, templates, and platform content (the “AFI Materials”) are protected by copyright and other laws.
   •    You receive a limited, non-exclusive, non-transferable, revocable license to use AFI Materials for your personal learning only while you are an enrolled student.
   •    You may not copy, resell, publicly share, upload to public sites, or create derivative works from AFI Materials without written permission.

Student Work Product. Homework, submissions, and other content you create in the course of your lessons may be stored and used by AFI for:
   •    Lesson planning and continuity
   •    Quality assurance and training
   •    Protecting AFI’s legal interests

We handle personal data in line with our Privacy Policy.

9. Recordings, Transcripts, and Accessibility


To support quality, safety, and learning:
   •    AFI may record certain lessons or sessions
   •    AFI may use automated tools to generate transcripts or captions
   •    Recordings may be made available to you for review while you are enrolled

By using the Services, you consent to such recordings and transcriptions.

We will not publicly publish your identifiable lesson recordings for marketing without your separate, explicit consent.

You agree not to:
   •    Record or distribute AFI lessons, screenshots, or audio without AFI’s written permission, except to the extent allowed by law for your own private study.

We make reasonable efforts to provide captions or transcripts but cannot guarantee accuracy.

10. Third-Party Tools and Services


AFI uses third-party tools such as Zoom, learning management systems, document storage, and translation or AI services.
   •    Your use of these tools is also subject to their own terms and privacy policies.
   •    AFI is not responsible for outages or limitations of third-party tools.
   •    We ma

y change our toolset at any time.

11. Community Standards and Discussions


Where AFI offers group classes, chats, or social events:
   •    You must treat others with respect.
   •    No harassment, hate speech, spam, or academic cheating.
   •    Instructors may redirect or end discussions that are off-topic, unsafe, or inappropriate.

AFI may remove users from group spaces and may terminate access to Services for serious or repeated violations.

12. Accreditation and Certificates


AFI is not an accredited school, college, or university.
   •    We may issue certificates of completion or participation for certain courses.
   •    These certificates indicate that you have taken part in a course with us.
   •    We cannot guarantee they will be recognised by any employer, school, government, or other third party.

13. Suspension, Termination, and Data Retention


We may suspend or terminate your access to the Services if:
   •    You violate these Terms or other AFI policies
   •    You engage in fraud, harassment, or illegal activity
   •    You create risk or harm for AFI, our staff, or other learners

If your access is terminated for cause:
   •    You may lose access to lessons, recordings, or unused time
   •    Fees already paid are normally not refunded

Data retention. AFI may retain account, payment, and lesson records to:
   •    Comply with legal and tax obligations
   •    Investigate complaints or safety concerns
   •    Protect AFI’s intellectual property and contractual rights

Where applicable law (such as GDPR or CCPA) gives you data rights, we will honour them to the extent legally permitted. Some records may be kept even after account closure for legal and operational reasons.

14. Copyright and IP Complaints (DMCA)


If you believe content provided through our Services infringes your copyright or other IP rights, you can contact us at legal@afienglish.com with:
   1.    Your name and contact details
   2.    Identification of the work you believe is infringed
   3.    The URL or location of the allegedly infringing content
   4.    A statement under penalty of perjury that you are authorized to act
   5.    Your physical or electronic signature

AFI may remove or restrict access to reported content and may terminate repeat infringers where appropriate.

15. Changes to Services and Terms


We may update:
   •    Our course offerings, schedule, and pricing
   •    Features of the platform
   •    These Terms

When we make material changes, we will update the “Effective Date” and may provide notice by email or on the website.

Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Services.

16. Disclaimers and Limitation of Liability


As-is. The Services are provided “as is” and “as available.” To the fullest extent permitted by law, AFI disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

No guarantee of results. AFI does not guarantee that using the Services will lead to particular test scores, admissions, immigration outcomes, jobs, or other results.

Limitation of liability. To the maximum extent permitted by law:
   •    AFI will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services.
   •    AFI’s total liability for any claim relating to the Services is limited to the amount you paid to AFI for Services during the three (3) months before the event giving rise to the claim, or USD $100 if you have not paid AFI.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. In that case, the limitation applies to the maximum extent allowed by law.

17. Indemnification


You agree to indemnify and hold harmless AFI, its owners, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of:
   •    Your breach of these Terms
   •    Your misuse of the Services
   •    Your content or conduct in lessons or community spaces

18. Dispute Resolution, Governing Law, and Arbitration


Governing law. These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules.

Informal resolution. Before bringing a legal claim, you agree to email us at contact@afienglish.com within 30 days of the issue and give us an opportunity to resolve it informally.

Arbitration. If we cannot resolve the dispute informally, you and AFI agree to resolve disputes through binding arbitration under the rules of the American Arbitration Association (AAA) for consumer disputes, before a single arbitrator located in Wyoming. Hearings may be conducted virtually.

You and AFI agree:
   •    No class actions or representative suits
   •    Each side generally pays its own legal fees, unless the law or arbitrator provides otherwise

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@afienglish.com with the subject “Arbitration Opt-Out” and including your name, account email, and a clear statement that you opt out of arbitration. If you opt out, disputes must be brought exclusively in the state or federal courts of Wyoming.

Claims for injunctive relief to protect intellectual property or confidentiality may be brought directly in court without waiving arbitration of any damages claims.

19. Notices and Contact


We may send notices via email, through the platform, or by posting on our website. You are responsible for keeping your contact information up to date. If you have questions about these Terms, you may contact:

20. Final Acknowledgment, Consent, and Acceptance
 

By accessing, enrolling in, or otherwise using any AFI English (Applied Fluency International LLC) website, platform, program, course, application, or service, you acknowledge that you have read, understood, and agree to be bound by both:

 

AFI English Terms of Service, including but not limited to provisions regarding:

 

Ownership of content and intellectual property;

Acceptable use of services and prohibited conduct;

Treatment of personal data versus institutional work product;

Suspension, termination, and data retention policies;

Refund, cancellation, and modification clauses; and

Governing law and jurisdiction.​

AFI English Privacy Policy, including but not limited to provisions regarding:

 

Collection, use, storage, and processing of your personal data;

Retention of personal data only as long as legally or operationally required;

Retention of institutional work product as AFI English property;

Your rights under GDPR, CCPA, and other applicable laws.

 

You further consent to the collection, use, storage, and processing of your personal data as outlined in the Privacy Policy, subject to your rights under GDPR, CCPA, U.S. federal law, and the laws of the State of Wyoming.

 

If you do not agree to the Terms of Service and Privacy Policy in their entirety, you must immediately discontinue all use of AFI English services.

 

Your continued use of AFI English services constitutes your ongoing acceptance of and consent to these Terms and this Privacy Policy, as they may be updated or modified from time to time at the sole discretion of AFI English. Updates will take effect immediately upon posting to our website or platforms.
